1.Object
These general conditions govern the contractual relations between ALEA and the customer and the conditions applicable to any purchase made through the merchant site www.terredefrance.fr
The customer declares having read these general conditions of sale.
Placing an order on the website www.terredefrance.fr implies the customer's full and unreserved acceptance of these general terms and conditions of sale.
These general conditions of sale shall prevail over any other general or specific conditions not expressly agreed to by ALEA.
ALEA reserves the right to modify its general conditions of sale at any time.
In this case, the changes will be applicable from the time they are posted online.
Each order placed on the Site is governed by the general conditions applicable on the date of the order.
2. Capacity and destination
The customer declares to be legally capable of entering into a contract and to be over 18 years of age.
Placing an order by minors requires that they have first obtained the consent of their legal representatives.
The customer is prohibited from purchasing products on the site for the purpose of reselling them. ALEA reserves the right to refuse an order whose quantities are clearly unusual for personal use.
3. Characteristics of the goods offered
The products are described and reproduced by ALEA with the greatest possible accuracy. However, ALEA draws the customer's attention to the fact that the photographs cannot ensure perfect similarity with the product offered for sale, particularly with regard to colors.
Differences may result from the color quality of the photographs, the difficulty of displaying the rendering of materials on the screen or, without being exhaustive, technical adaptation. These differences cannot be interpreted as defects of conformity and lead to the cancellation of the sale.
In the event of a manifest error or non-significant omission between the characteristics of the product and its representation and/or description, ALEA cannot be held liable.
The product offers and prices appearing on the site are valid as long as they appear on the site, within the limits of available stocks.
In the event that a product is unavailable, ALEA undertakes to inform the customer as soon as possible by email or telephone and to indicate, where applicable, the estimated waiting time for delivery of the product.
The customer may confirm his order or request a refund of the product based on the price charged.
The preparation and delivery costs will be refunded to the customer if the latter confirms the cancellation of the entire order.
The preparation and delivery costs will remain the responsibility of the customer if the latter confirms the delivery of one or more available products forming part of the same order.
4.Price
The prices of the products offered for sale on the site www.terredefrance.fr are expressed in euros, including French VAT, and are valid only on the site.
ALEA reserves the right to modify the price of its products at any time and without prior information to the customer, in particular in the event of an obvious error (typography or printing) or a change in the VAT rate.
The products ordered are invoiced to the customer on the basis of the price in effect on the site at the time the order is validated by the customer.
5.Order
5.1 Creation of an ALEA account
Creating an ALEA account is optional to make a purchase on the website www.terredefrance.fr
5.2 Advantage code
The customer who benefits from an advantage code is invited to enter it after identification and at any time when creating their basket.
5.3 Order placement stage
All stages of the sale are clearly identified on the site in accordance with the provisions of Article 1369-1 of the Civil Code. In application of these provisions, the customer has the possibility to check the details of his order and its total price and to correct any errors before definitively validating his order.
The order is only definitively registered after validation by the customer of his payment agreement and acceptance by the bank of the transaction. The summary of the customer's order is available in printable version, via the order confirmation email.
As soon as the order is registered, the customer receives a confirmation email containing the essential elements of the order, including the order number, the list of products ordered and the price details.
All data provided by the customer during the ordering process and the recorded confirmation of this order constitute proof of the transaction.
ALEA reserves the right to refuse any order from a customer with whom there is a dispute relating to the payment of a previous order until this dispute is resolved.
6.Payment
The customer can pay for their purchases by bank card.
The following bank cards are accepted: Carte Bleue, Visa and Mastercard.
When finalizing their order, the customer is asked to enter their bank card number, the expiration date of their bank card and the last 3 digits of the visual cryptogram on the back of the card.
8.Delivery
The delivery area is limited to mainland France, including Corsica.
The delivery times indicated below are subject to adjustment depending on the period in which the customer places the order (sales, holidays, etc.)
The delivery costs correspond to a fixed amount which depends on the delivery method chosen by the customer.
Delivery methods are offered to the customer:
Home delivery in mainland France, including Corsica
The order is delivered by La Poste in Colissimo Access to the delivery address entered by the customer within 9 working days from confirmation of the order.
The customer is informed of the shipment of their package by email.
Delivery to Mondial Relay collection point in Metropolitan France, including Corsica
The order is delivered by Mondial Relay to the collection point chosen by the customer within 9 working days from confirmation of the order.
The customer is informed of the shipment of their package by email.
9. Legal right of withdrawal
In accordance with article L121-21 of the consumer code, the customer benefits from a legal withdrawal period of 14 days from receipt of their order.
The customer may notify ALEA by mail of his intention to exercise this right by specifying his surname, first name, address, order number, date of placing the order, date of receipt of the order and reference of the item concerned by the withdrawal. Send to the following address:

The customer may also use the model withdrawal form (reproduced following these general conditions of sale) but this is not obligatory.
The customer then has 14 days from the sending of this letter to return their order (see article 10 Returns).
ALEA will reimburse the customer within 14 days of receipt of the order or proof of return of the order (see article 11 Reimbursement).
11. Reimbursement
The customer will be reimbursed on the payment method used when ordering, based on the price of the product invoiced appearing on the order summary and the preparation and delivery costs actually paid by the customer.
No refund will be made in store except in the event of an exchange for a product whose price is lower than the returned product.
The customer will be reimbursed within 5 to 10 working days from receipt of the package by ALEA.
12. Transfer of ownership/transfer of risks
The transfer of ownership of the products to the customer will only take place after full payment of the price by the latter, regardless of the date of delivery of said products.
On the other hand, the transfer of risks of loss and deterioration of the products will be carried out upon delivery and receipt of the products by the customer.
13. Warranty
All products sold on the site www.terredefrance.fr benefit from legal guarantees of conformity and hidden defects.
Article L211-4 of the Consumer Code
“The seller is required to deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery.
It is also liable for any lack of conformity resulting from the packaging, assembly instructions or installation when this has been placed under its responsibility by the contract or has been carried out under its responsibility.
Article L211-5 of the Consumer Code
“To comply with the contract, the property must:
1° Be suitable for the use usually expected of a similar good and, where applicable:
– Correspond to the description given by the seller and possess the qualities that the latter presented to the buyer in the form of a sample or model;
– Present the qualities that a buyer can legitimately expect in light of the public statements made by the seller, the producer or his representative, particularly in advertising or labelling;
2° Or present the characteristics defined by mutual agreement by the parties or be suitable for any special use sought by the buyer, brought to the attention of the seller and which the latter has accepted.
Article L211-12 of the Consumer Code
“The action resulting from the lack of conformity is prescribed by two years from the delivery of the good”.
Article 1641 of the Civil Code
"The seller is bound by the guarantee for hidden defects in the thing sold which make it unfit for the use for which it is intended, or which so diminish this use that the buyer would not have acquired it, or would have paid a lower price for it, if he had known of them."
Article 1648 of the Civil Code
“The action resulting from latent defects must be brought by the purchaser within two years from the discovery of the defect”

15. Liability
ALEA cannot be held liable:
– For non-performance of the contract in the event of out of stock or unavailability of the product due to a case of force majeure;
– Any damage resulting from the use of the Internet network such as loss of data, intrusion, viruses, service interruption, or other involuntary problems;
– The content of sites to which hypertext links may refer from its own site.
16. Intellectual Property
All elements of the site www.terredefrance.fr are and remain the intellectual and exclusive property of ALEA.
The customer is not authorized to reproduce, exploit, distribute or use in any capacity whatsoever, even partially, elements of the site whether software, visual or audio.
Copyright
The texts, images, drawings and layout as well as the graphic charter of the site www.terredefrance.fr are protected by intellectual property law.
It is forbidden to copy, extract, distribute, modify or adapt the content of this site. Downloading and printing of text, images and graphic elements are authorized for private and non-commercial use only.
The reproduction of drawings, images, sound documents, video sequences and texts in other electronic or printed publications requires the prior written consent of ALEA. Failure to obtain permission is punishable by the offence of counterfeiting.
Brands
The brands and logos appearing on the site are protected trademarks.
Any total or partial reproduction of these brands and/or logos, made from elements of the site without the express authorization of ALEA constitutes counterfeiting punishable by articles L335-2 and following of the Intellectual Property Code.
Hyperlinks
Any simple or hypertext link is strictly prohibited without the express written consent of ALEA.
17.Archiving
In accordance with the provisions of Article 1348 of the Civil Code, ALEA archives purchase orders and invoices on a reliable and durable medium constituting a faithful copy.
In accordance with the provisions of Article 132-4 of the Consumer Code and the decree of February 16, 2005, orders of any amount are archived and kept by ALEA for 10 years.
ALEA's computerized records will be considered by ALEA and the customer as proof of communications, orders, payments and transactions between ALEA and the customer.
ALEA retains the possibility of communicating with the customer via the email address indicated by the customer, in compliance with GDPR regulations. The customer agrees to receive occasional information on ALEA news, while retaining the possibility of unsubscribing from these information emails.
18. Disputes
These general terms and conditions of online sale are subject to French law. Any disputes that cannot be settled amicably will be brought before the competent courts of the defendant's domicile or the place of delivery or the jurisdiction of the ALEA head office.
